Terms and Conditions of Service
Caliber Tree Experts, LLC
(“Company,” “we,” “us,” or “our”)
Doing business in the State of Florida
These Terms and Conditions govern all tree care services provided by Caliber Tree Experts, LLC to the customer (“Client,” “you,” or “your”). By approving an estimate, scheduling services, or allowing work to commence, Client agrees to these Terms and Conditions.
1. Scope of Work
The scope of work is limited strictly to the services described in the written estimate or invoice provided by Caliber Tree Experts, LLC. Any additional services requested by Client must be approved in writing and may result in additional charges.
2. Estimates and Pricing
- Estimates are based on visible conditions at the time of inspection.
- Prices may change if site conditions differ from what was reasonably observable (including but not limited to underground utilities, hidden decay, access limitations, or changes in tree condition).
- Estimates are valid for 30 days unless otherwise stated.
- Pricing does not include permit fees unless explicitly noted.
3. Payment Terms
- Payment is due immediately upon completion of services, unless otherwise agreed to in writing.
- Company reserves the right to require full payment in advance or a non-refundable deposit for any project, at Company’s sole discretion.
- Client agrees that failure to pay upon completion constitutes a material breach of this agreement.
- Any unpaid balance after 3 calendar days will be considered delinquent.
- Delinquent balances will accrue interest at 1.5% per month (18% annually) or the maximum rate permitted under Florida law, whichever is less.
- Client agrees to pay all costs of collection, including but not limited to administrative fees, collection agency fees, court costs, filing fees, and reasonable attorney’s fees.
- Company reserves the right to file a lien, pursue legal action, or suspend future services for non-payment without further notice.
4. Cancellations and Rescheduling
- Client must provide a minimum of 48 hours’ notice to cancel or reschedule services.
- Deposits are non-refundable once a job is scheduled.
- Cancellations made within 48 hours of the scheduled service date may result in a cancellation fee of up to 50% of the total estimate.
- Same-day cancellations, denial of access, or failure to prepare the property as required will result in full forfeiture of the deposit and may be billed up to 100% of the quoted price.
- Weather-related delays, unsafe conditions, equipment issues, or crew availability may require rescheduling at Company’s sole discretion and do not constitute grounds for cancellation or refund.
5. Access and Utilities
- Client agrees to provide clear and safe access to the work area.
- Client is responsible for identifying and marking all underground utilities, irrigation lines, septic systems, invisible fences, and private lines prior to service.
- Caliber Tree Experts, LLC is not responsible for damage to unmarked or privately owned utilities.
6. Property Damage and Risk Acknowledgment
- Tree work involves inherent risks. While all reasonable precautions are taken, incidental damage may occur.
- Company is not responsible for pre-existing damage or conditions.
- Minor damage to lawns, landscaping, driveways, walkways, or irrigation systems may occur and is considered a normal part of tree work.
- Company is not responsible for soil compaction, root disturbance, or cosmetic turf damage.
7. Stump Grinding and Root Removal
- Stump grinding is performed to a depth determined by Company, typically 6–12 inches below grade, unless otherwise specified.
- Surface roots may remain.
- Client is responsible for restoration, including soil replacement, sod, or landscaping, unless otherwise stated in writing.
8. Debris Removal
- Unless specified, pricing includes removal of tree debris generated by Company.
- Firewood, logs, or mulch are removed unless Client requests otherwise in writing prior to service.
- Company is not responsible for debris resulting from work performed by others.
9. Permits and HOA Approval
- Client is responsible for obtaining all required permits, homeowner association approvals, or municipal permissions unless otherwise stated in writing.
- Company is not liable for fines, penalties, or stop-work orders related to missing approvals.
10. Insurance and Liability
- Caliber Tree Experts, LLC maintains applicable liability and workers’ compensation insurance as required by Florida law.
- Company is not responsible for damages caused by acts of God, including but not limited to storms, lightning, flooding, or wind events.
11. Warranty and Tree Health Disclaimer
- No guarantee is made regarding the continued health, stability, or survival of any tree.
- Tree trimming, pruning, or treatment does not ensure protection from disease, pests, or future failure.
12. Independent Contractor Status
Caliber Tree Experts, LLC operates as an independent contractor. No partnership, joint venture, or employment relationship is created.
13. Limitation of Liability
To the fullest extent permitted by Florida law, Company’s total liability for any claim, damage, or cause of action arising out of or related to services performed—whether based in contract, tort, negligence, or otherwise—shall be strictly limited to the amount actually paid by Client for the specific service giving rise to the claim. In no event shall Company be liable for indirect, incidental, consequential, or special damages, including loss of use, loss of enjoyment, or lost profits.
14. Indemnification
Client agrees to indemnify and hold harmless Caliber Tree Experts, LLC from any claims, damages, or expenses arising from Client’s failure to comply with these Terms, including failure to disclose hazards or property conditions.
15. Governing Law and Venue
These Terms and Conditions shall be governed by and interpreted under the laws of the State of Florida. Venue for any dispute shall lie in the county where the services were performed.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms and Conditions, together with the written estimate or invoice, constitute the entire agreement between the parties.
18. Acceptance
Client expressly acknowledges that these Terms and Conditions are binding and enforceable. Approval of an estimate, payment of any deposit or invoice, electronic acceptance, text message confirmation, or allowing work to commence constitutes full acceptance of these Terms and Conditions. Client waives any claim that these Terms were not read or understood.
